AGREEMENT OF PHOTOGRAPHIC SERVICE
PHOTOGRAPHIC SERVICE
1.1 - On the wedding day, the photography service, provided by two Lapela photographers, begins at the time previously agreed upon with the client. The photography coverage time varies depending on the package chosen. Hours run consecutively and start from the moment of our arrival. Once this time has elapsed, should the clients wish to extend our services, extra hour(s) will be charged.
1.2 – The fees paid cover the provision of the following photography services:
Coverage of the wedding day, accompanying the bride and groom, and subsequent digital editing of the best photographs.
Delivery of all edited high-resolution photos in digital format, free of logos/watermarks, for unrestricted use or copying. (Lapela does not sell individual photographs. It is the clients' responsibility to share them with family members or guests).
Other optional services chosen by the clients.
1.3 – Under normal conditions, the final photography package delivered will include a minimum of 600 images, with no maximum limit or additional costs. Please note that the selection of the best photos to be edited is at the exclusive discretion of the photographers. RAW/digital negatives will not be delivered.
1.4 - The delivery time for the photos varies (depending on the time of year) and can take up to 4 months after the wedding date.
1.5 - Lapela does not charge for travel expenses for events within the Algarve geographic region. For events outside the Algarve, a respective travel fee may or may not be quoted.
PRICE, PAYMENT TERMS and PRODUCT
2.1 - To secure our photography services, a non-refundable booking deposit of €200 is required.
2.2 - The payment schedule is structured as follows: a €200 deposit upon booking, with the remaining balance due closer to the wedding day.
2.3 - Failure to pay the total agreed amount relieves Lapela from any obligation to deliver the final work.
2.4 – By signing below, the client confirms that they are well acquainted with Lapela Photography's portfolio and artistic style, and therefore grants full creative freedom to the photographers.
2.5 - The captured photographs will undergo an editing process in Adobe Lightroom (selection, exposure, color, and contrast adjustments, minor corrections, etc.), which is considered an integral part of the independent creative work mentioned in clause 2.4. Depending on our workload and the time of year, the delivery period may take up to 4 months after the wedding date. We will deliver all the best photos in high-resolution JPEG format (RAW files will not be delivered).
2.6 – Lapela Photography answers exclusively to the contracting party (or parties) and will not permit third-party interference.
2.7 – The client(s) authorize the publication of the photographs covered by this agreement for the promotional purposes of Lapela Photography on the website lapelafotografia.com and its respective social media channels. For any other specific or commercial situations, prior authorization will always be requested from the clients.
2.8 - If, during the service, there is a lack of safety or any act of violence (verbal, physical, or otherwise) directed at any Lapela Photography professional, the service will be promptly terminated. In this event, neither party shall have the right to claim any compensation or indemnity.
3 - In the event of cancellation by the client, any amounts already paid will not be refunded.
3.1 - If Lapela Photography fails to provide the service due to health reasons or other events of force majeure where both photographers are prevented from working, the amount received will be refunded in full. In the unlikely event that only one photographer is able to be present on the wedding day, the base price will be reduced by 20%. Lapela will make every effort to replace the absent professional with another photographer of similar artistic sensibility and quality.
MISCELLANEOUS
4.1 – Lapela Photography shall not be held responsible for photos that may not be captured due to lack of available time (please refer to our brochure guidelines), difficulty accessing certain locations, or shots that were not previously requested. Furthermore, the photographers are under no obligation to take photos at the request of anyone other than the clients signing this agreement.
4.2 – Lapela Fotografia shall be entitled to a 30-minute break for a proper meal during dinner (preferably at the same time the newlyweds are eating), which is to be kindly provided by the clients. If a meal is not provided, the photographers may need to leave the venue to eat elsewhere.
4.3 - The photos will be stored on backup drives for a period of 2 years. No additional fee will be charged for requesting a second copy of the final product within this timeframe. After this period, Lapela Fotografia shall have no further liability or obligation to the clients.
If both parties are in perfect agreement over the above statements in this document, there is therefore an obligation to fulfill what is denominated by filling in below and submitting to Lapela.
